THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Petition No.2072 of 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, seeking to quash the proceedings in Crime No.28 of 2018 on the file of Asifnagar Police Station, Hyderabad District, registered for the offences under Sections 384, 448, 506 of I.P.C.

Heard the learned counsel for the petitioner/A.1, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

The learned counsel for the petitioner/A.1 would submit that the de-facto complainant and the petitioner/A.1 are friends. No alleged threats were made. The impugned report was lodged with the police to harass the petitioner/A.1 and ultimately prayed to allow the application. 4.

The learned Assistant Public Prosecutor opposed the application.

As per the report, dated 08.02.2018, lodged by the de-facto complainant with the police, on 07.02.2018, at 23:33 hours, the petitioner/A.1 called the de-facto complainant by phone and ordered him to come to Prince Hotel at Mehdipatnam. The de-facto complainant refused to go to that hotel. Then, the petitioner/A.1 abused him in filthy language, threatened to kill him. Again on 08.02.2018, at 13:57 hours, the petitioner/A.1 called the de-facto

complainant and threatened him. The threats continued in the year 2017 also. There is also specific allegation that the petitioner/A.1, along with the other accused, criminally trespassed into the house of the de-facto complainant situated at Murad Nagar and demanded an amount of Rs.1,00,000/-. When the de-facto complainant did not give money, he was abused in filthy language, scolded and threatened. There are also other allegations against the petitioner/A.1. Truth or otherwise of the allegations can be determined after investigation. Continuation of investigation will not amount to abuse of process of law. The allegations also disclose the offences enumerated above. There are no merits to allow this Criminal Petition. 6.

Hence, the Criminal Petition is dismissed.

Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
