HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5725 of 2018 ORDER:

Heard learned counsel for the petitioners and learned Government Pleaders for Fisheries & Revenue respectively for respondents and perused the prayer in the writ petition with the supporting affidavit and the written instructions received by the learned Government Pleader from the Joint Director of Fisheries, Machilipatnam.

A perusal of the written instructions show out of the fish tanks covered by several survey numbers of Kaikaluru Village, so far as R.S.Nos.128/1 & 129/1 concerned those are not with any permission and they applied for regularization as per G.O.Ms.No.32 dated 25.10.2017, which are pending and so far as repairs of the existing tanks including those subject matter for regularization concerned, it is the say from the counter that there is no provision to accord specific permission. Having regard to the above and by recording the same, the Writ Petition is disposed of by enabling the petitioners to attend repairs but under the guise of repairs they cannot widen the tank area or dug extra tanks.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
