ORDER

The petitioner was appointed as a dealer of fair price shop No.52 of Rayavaram Village, Macherla Mandal, Guntur District. The authorisation of the petitioner was valid up to 31.03.2016. On 12.08.2015 the shop of the petitioner was inspected and found some irregularities. A panchanama was conducted and on the basis of the report, thereby 6 A proceedings were initiated and they are pending before the Joint Collector, Guntur District. When commodities were not supplied to the petitioner for onward distribution to the card holders for the month of September, 20015, the present writ petition is filed.

The case underwent three adjournments and today learned Government Pleader for Civil Supplies (A.P.) submits that only 6A proceedings were pending. In view of the said submission, it is clear that no disciplinary proceedings were taken against the petitioner. So long as the authorisation of the petitioner is in force and valid, the petitioner is entitled to supply of commodities. In the circumstances, the writ petition is allowed by directing respondents 2 and 3 to supply the essential commodities to the petitioner till the authorisation of the petitioner is in force and valid.

Accordingly, the writ petition is allowed. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ A RAMALINGESWARA RAO, J Date:07.10.2015 BV
