THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5699 of 2016 ORDER:
The petitioners are working as Clerk and Cashier respectively in the respondent No.5 Society. Respondent No.4 issued proceedings on 08.10.2015 in exercise of the powers conferred under Section 59(1) of the Andhra Pradesh Cooperative Societies Act, 1964 directing the Person In-charge Committee to initiate disciplinary action against the C.E.O., Cashier and Loan Clerk of the Society.
Thereafter, proceedings were issued by the Person In-charge Committee on 13.10.2015 placing the petitioners under suspension. The said order was suspended by this Court by order dated 23.02.2016, as a result of which, the petitioners are continuing in service. However, seeking vacation of the said interim order dated 23.02.2016, respondent No.5 filed W.V.M.P.No.1231/2016 and the respondents 1 to 4 filed W.V.M.P.No.3057/2016.
When the aforesaid vacate petitions are taken up for consideration, learned counsel for the vacate petitioners submits that the vacate petitioners have no objection for continuance of the petitioners, pending the disciplinary proceedings against them, but the petitioners shall cooperate for conclusion of the disciplinary proceedings initiated against them.
ARLR, J W.P. No.5699 of 2016 In view of the said submission, this Court, without going into merits of the case, gives liberty to respondent No.5 to go ahead with the enquiry initiated against the petitioners and the petitioners shall cooperate with the conclusion of the enquiry.
Accordingly, this Writ Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
