D.Vemanna v. State Of Ts
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2073 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A4, in Crime No.33 of 2018 on the file of Manopadu Station, Jogulamba District. The offences alleged are under Sections 406, 420, 384 and 120B of IPC.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The case of the prosecution is, that while the defacto complainant was trying to transport sheep illegally, the petitioner who is ASI, along with A1, promised to help him out without a case being registered against him and later, they got the case booked. Hence, whole allegations would show that these petitioners tried to support the illegal actions and that they tried to help an illegal transaction. 4.
Hence, considering the above facts, this court opines that this is not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed.
However, the petitioner is at liberty to file a petition seeking for regular bail by surrendering himself before the court below having the jurisdiction. The court below shall dispose of the bail application on merits, if any filed, expeditiously,
preferably on the same day, subject to the pressure of other work.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 28.02.2018 SS
