THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2026 OF 2016 O R D E R :

Complaining willful disobedience on the part of the respondent of the order dated 01.04.2016 passed by this Court in Writ Petition No. 10772 of 2016, this Contempt Case has been filed.

Writ Petition No. 10772 of 2016 was instituted seeking action against the 5th respondent - Sarpanch, Kodair Gram Panchayat for the alleged misappropriation of funds of the 6th respondent gram panchayat. Through the order dated 01.04.2016, this Court directed the respondent herein to consider the representation of the petitioners and take appropriate action in accordance with law.

Today, learned counsel for the respondent has placed on record a copy of the proceedings dated 23.02.2017 of the District Panchayat Officer, Nagarkurnool, whereunder further action against the Sarpanch of Kodair Gram Panchayat was dropped fixing the responsibility on the Panchayat Secretary. In view of the said proceedings, the learned counsel submits that the order complained of in this Contempt Case can be said to have been complied with.

A perusal of the proceedings dated 23.02.2017 discloses that in compliance with the order dated 01.04.2016 in Writ Petition No. 10772 of 2016, the respondent has conducted inquiry against the Sarpanch of Kodair Gram Panchayat and dropped further action against him fixing the responsibility on the Panchayat Secretary, hence, nothing remains in this Contempt Case for adjudication.

The Contempt Case is accordingly, closed.

Consequently, the miscellaneous Applications, if any shall also stand closed.
