THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5672 of 2018 ORDER:

This Writ Petition is filed challenging the action of the third respondent in interfering with the possession of the property of the petitioner situated in Municipal Nos.18-2-60/82, 18-2-60/83, 18-2-60/86 and 18-2-60/83/4/A of Jangammet, Falaknuma, Hyderabad, admeasuring square yards pursuant to the proceedings issued under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905, for which objections were filed by the petitioner on 14.02.2018. Learned Counsel for the petitioner submits that in spite of filing objections to the notice dated 06.02.2018, the third respondent visited the site on 16.02.2018 and is trying to disturb the possession of the petitioner.

Since the petitioner filed objections within seven days after receipt of the notice dated 06.02.2018, the third respondent cannot interfere with the possession of the petitioner without passing final order. If no final order is passed by the third respondent, the third respondent is directed to pass the final order in accordance with law and serve a copy of the same to the petitioner and till such time, the property of the petitioner covered by the notice under Section 7 of the Andhra Pradesh Land Encroachment Act shall not be interfered with.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 21.02.2018 Note: Issue C.C in one week.
