THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CCCA MP No.522 of 2015 in CCCA No.104 of 2010 and CCCA No.104 of 2010 Common Order:
Appellant/defendant-Syed Yousuf and his counsel Sri M.V.S.Suresh Kumar are present. Respondents 2 to 4 and their counsel Sri S.A.Razak are present and they are identified by their respective counsel.
2) The appeal-CCCA No.104 of 2010 is filed by the appellant/defendant against the judgment dated 11.03.2010 in O.S.No.279 of 2008 on the file of X Additional Senior Civil Judge, (FTC) City Civil Court, Hyderabad whereunder the trial Court decreed the plaintiff's suit for specific performance of suit agreement to sell in respect of plaint schedule property and directed the defendant to execute a registered sale deed in favour of plaintiff. The sale consideration was Rs.7 lakhs; out of which 3 lakhs was paid at the time of agreement of sale dated 22.06.2007 and balance amount of Rs.4 lakhs was deposited by the plaintiff after the decree.
3) Pending appeal the sole respondent/plaintiff died and his LRs.-wife and two sons were brought on record as R2 to R4.
4) At this stage both the parties entered into compromise and submitted compromise petition. The terms of compromise are mentioned in the compromise petition. Both the parties and their learned counsel admitted the terms of the compromise before
the court.
5) In terms of the compromise, the CCCA No.104 of 2011 is disposed of without costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
