THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU A.S.No.13 of 2016 JUDGMENT:

Mr.N.Srihari, learned counsel for the appellant, submitted an application, seeking permission to withdraw the appeal. Learned counsel for the respondents appears and states that he has no objection if the appeal is allowed to be withdrawn. He prays for costs. He also points out that in the lower court the suit was dismissed with costs.

This court is of the opinion that in view of the fact that matter is being withdrawn, the respondents are not entitled to any costs. Permission is accorded to the learned counsel for the appellant for withdrawal of the appeal overruling the objection of the learned counsel for the respondents.

The Appeal is accordingly dismissed as withdrawn. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
