THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2529 OF 2016 ORDER:

This petition is filed by the petitioner-A1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.69 of 2016 on the file of Malkajgiri Police Station, Cyberabad, registered for the offence punishable under Sections 420, 346, 406, 418, 471, 120-B and 506 IPC.

Heard and perused the material available on record. It is alleged that A1 in collusion with other accused hatched up a plan to grab the property of the de facto complainant, wrongfully confined him and by putting him under threat and coercion, the accused got two sale deeds executed in respect of the property of the de facto-complainant and A1 withdrew the amount from the bank account of the de facto complainant.

Considering the facts and circumstances of the case and the nature of the allegations, this Court is not inclined to grant the relief sought by the petitioner. At this stage, the learned Counsel for the petitioner submitted that the present complaint has arisen out of civil disputes between the petitioner and the de factocomplainant and that the investigation is based on the documents and that due to the pendency of the above crime, the petitioner apprehends arrest and harassment in the hands of the 2nd respondent-police.

In view of the above submission, the 2nd respondent-police are directed to complete the investigation and file a final report, if any, without arresting the petitioner. In the event of necessity, the 2nd respondent-police are directed to issue notice to the petitioner for his appearance before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioner shall appear

before the investigating agency and give an undertaking as to his future appearance as and when required by the investigating agency for the purpose of investigation. With the above direction, the Criminal Petition is disposed of.
