Petitioners claim to be belonging to Backward and Schedule Tribe community. They were allotted 80 Square yards of house site plot each in Sy.Nos.471/4, Patelgudem Village, Lingalaghanpuram Mandal, Jangaon District. According to the petitioners they are in possession and occupation of the said properties. While so, on 17.06.2017 each of the petitioners were served with notices alleging that they have violated the terms of assignment granted to them and why the assignment should not be cancelled and land should not be resumed. According to the petitioners they have submitted their explanations. However, without waiting for the orders to be passed by the Tahsildar, this writ petition is filed.

It is not in dispute that the Tahsildar is competent to issue such notice whenever it comes to his knowledge that the terms of patta granted to the assignees are violated. Therefore, the Court is not inclined to entertain the Writ Petition.

However, it is needless to observe that since the notices were issued and explanations were submitted by the petitioners, the Tahsildar would pass orders by duly considering the explanations submitted by the petitioners.

With the above observations, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
