Heard learned counsel for the petitioners, learned Government Pleader for Revenue appearing for the respondents 2 and 3, Sri N.Praveen Kumar, learned Standing Counsel for respondent No.4 and Sri Farhan Azam Khan, learned Standing Counsel for respondent No.5. With their consent, the present Writ Petition is disposed of.

The present Writ Petition came to be filed seeking to declare the inaction on the part of respondent No.5 in taking steps to conduct enquiry as per the Wakf Act, by deputing an Enquiry Officer/Wakf Inspector, in respect of land to an extent of Ac.4.00 cents in Survey No.330/2, situated at Bhainsa, Nirmal District, as arbitrary and illegal.

At the time when the matter is taken up for hearing, it is brought to the notice of this Court that enquiry has already been conducted as per the procedure contemplated under the Act. 4.
In view of the above, this Court is of the opinion that the request of the petitioners was already addressed to and if aggrieved by the report, the petitioners can challenge the same. 5.
