THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No 5653 of 2018 ORDER:
This Writ Petition is filed challenging the action of the respondents in proposing to widen the existing 50' road of Prakasam High Road i.e., from New Collectorate to Venkusa Kalyana Mandapam, Chittoor as 100' road by contemplating to demolish the properties of the petitioners lying on either side of the Prakasam High Road without issuing notice and without following due process of law.

The claim of petitioners is that they are owners of the adjacent land where the proposal for road widening is being taken up. The petitioners alleged that no proceedings are initiated under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short, 'the Act') and no compensation whatsoever has been paid to them while the respondents are undertaking the work of road widening. 3.
The learned Government Pleader for Municipal Administration & Urban Development appearing for the respondents, on instructions, submits that the respondents would strictly follow the procedure before, in any manner, interfering with the property of the petitioners.

Having regard to the stand taken by the learned Government Pleader, this Writ Petition is disposed of directing the respondents not to interfere with the petitioners' properties, in any manner, without following due process of law as enshrined in the Act.
Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
