THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 16296 of 2004 ORDER:

This writ petition was filed assailing the action of the respondents in not issuing a Duty Free Replenishment Certificate to the petitioner unit pursuant to the application dated 14.06.2004. By interim order dated 13.09.2004, this Court directed the Joint Director General of Foreign Trade, Mumbai, to pass appropriate orders on the application filed by the petitioner on 14.06.2004 and intimate the action taken thereon within a period of two weeks from the date of receipt of a copy of the said order.

Learned counsel for the petitioner is however unable to state as to whether any action was taken pursuant to the interim order. In the light of the interim order passed as long back as in the year 2004, this Court is of the opinion that the cause in this writ petition no longer survives.

In the event, the petitioner's grievance still remains unredressed, it shall be open to it to seek appropriate remedies in accordance with law.

The writ petition is therefore closed with the liberty aforestated. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
