B. Pichamma v. The Tahsildar

THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.5777 of 2018 Order:

This Writ Petition is filed challenging the action of the respondents in not considering the representation of the petitioner dated 19.07.2017 for correction of revenue records in respect of the land of an extent of Ac.3-07 gts., situated in Survey No.314/1/10 of Samithisingaram village, Manuguru Mandal, Bhadradri-Kothagudem District.

This Court noticed that the petitioner submitted a representation without following the procedure prescribed under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act and the rules made therein. As per sub-Section (3) of Section 3 of the ROR Act, the appropriate remedy is to file proper application seeking correction of entries to the concerned Tahsildar.

In view of the same, liberty is given to the petitioner to submit an appropriate application to the Tahsildar for correction of revenue records in accordance with the rules and, as and when such application is filed by the petitioner, it is needless to observe that the first respondent - Tahsildar shall consider the same and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of such application. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
