HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SMT. JUSTICE T.RAJANI Writ Petition No.27976 of 2017 Order: (per V.Ramasubramanian, J.) The petitioner who hails from East Godavari District in Andhra Pradesh has come up with the above writ petition, challenging the action of the respondents in not treating her as a local candidate, in terms of the Presidential Order, 1974.

2. Heard Mr. B.Sesibushan Rao, learned counsel for the petitioner and Mr. Taddi Nageswara Rao, learned Standing Counsel for the 4th respondent/University.

3. It appears that the petitioner studied from Classes-I to X in Nagpur, Maharashtra State and Higher Secondary Course in the State of Karnataka. Therefore, the respondents could not treat her as a local candidate within the meaning of para-4(1) of the Presidential Order, 1974. At least if the petitioner had studied part of her curriculum in the State of Andhra Pradesh, the case of the petitioner could have been considered favourably, in view of the fact that her father is employed in the Central Reserve Police Force. Wherever the parents are employed in the Army or Paramilitary Forces, the requirements of para-4(1) and para-4(2) cannot be held to be rigid. But in cases of this nature, where the candidate has not studied even for a single year, the same logic cannot be applied. In any case, the admissions for the current academic year are over. Therefore, no relief can be granted to the

petitioner. Hence, the above writ petition is dismissed. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
