HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 5659 of 2006 Order:

This Writ Petition was filed challenging the action of the second respondent in not receiving the claim/objection application of the petitioners pursuant to the auction notice dated 27.02.2006 notifying that property owned by the petitioners would be sold in a public auction to be conducted on 28.03.2006 to recover income tax arrears pertaining to the third respondent.

This Court, while admitting the Writ Petition on 23.03.2006, directed the second respondent to entertain the claim petition filed by the petitioners and to deal with the same and pass appropriate orders before proceeding with the auction of the properties pursuant to the auction notice dated 27.02.2006.

In view of the said interim direction which is in the nature of a main relief, no further orders are necessary in the present Writ Petition. It is always open to the petitioners to take appropriate proceedings, if an adverse order is passed by the competent authority, the second respondent.

The Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
