THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.95 of 2017 JUDGMENT:
This appeal is filed under Section 100 CPC aggrieved by the judgment and decree dated 19.10.2016 in A.S.No.153 of 2007 on the file of the Court of VI Additional District and Sessions Judge (Fast Track Court), Tirupati, whereby where under the judgment and decree dated 11.12.2007 in O.S.No.651 of 2001 on the file of the Court of Principal Junior Civil Judge, Tirupati, dismissing the suit filed by the plaintiffs for permanent injunction, was confirmed.

At the time of hearing, learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the second appeal with a liberty to avail the remedies available to them under law in view of pendency of O.A.No.649 of 2014 on the file of the A.P.Endowments Tribunal. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn at the stage of admission granting liberty to the appellants to avail the remedies available to them under law.
