ORDER:

The petitioner has joined as Junior Assistant on 17.08.2017 in respondents Organisation. He is promoted as Senior Assistant by order dated 25.01.2007. On promotion, the petitioner is posted to R & B Division, Jangaon. The petitioner seeks retention in the same station where he is working as junior assistant. It is appropriate to notice that by the order impugned seven persons were granted promotion and on promotion respective postings were issued. It is seen from the proceedings, the 1st person in the list was shifted from R & B Division Office, Khammam to R& B Division office, Sattupally, where the petitioner was working in the lower post.

2) It is also seen that the petitioner has been working in Sattupally as Junior Assistant and now he is promoted and posted as Senior Assistant, R & B Division, Jangaon. 3) Since petitioner is promoted and posted to R & B Jangaon and unless the petitioner joins in the said place, promotion cannot come into effect. The petitioner cannot assume the promotion in the post of Senior Assistant at the present place without an order of posting. It is not in dispute that on promotion, a person can be transferred and posted as per the choice of competent authority. There is no motive attributed to the competent authority in transferring the petitioner from the present place of working. Hence, I see no error in the impugned order. However, it is for the petitioner to persuade competent authority

for modification of the order of posting on promotion, by making a request, after joining in the place of posting on promotion. 4) The Writ petition is, accordingly, dismissed. No order as to costs.

Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
