THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.2107 of 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner-A.3 seeking to quash the proceedings against him in Crime No.76 of 2018 of Vanasthalipuram Police Station, Ranga Reddy District, registered for the offences under Sections 120B, 406, 420, 467, 468, 471 472 I.P.C. 2.

Heard the learned counsel for the petitioner-A.3, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

Learned counsel for the petitioner-A.3 would submit that the petitioner-A.3 owns a Mee-Seva centre; today also, he is operating the same; his licence has not been cancelled; there are no allegations against him regarding malfunctioning; the petitioner-A.3 is not responsible for any of the offences; and ultimately, prayed to quash the proceedings. 4.

Learned Assistant Public Prosecutor would submit that the petitioner-A.3 is active participant in issuing fabricated birth certificates, through Mee-Seva centre only he used to take print outs of birth certificates; the petitioner-A.3 is well aware of the GHMC data entry operators and by collecting data from them, issued fake birth certificates changing names, etc., by taking Rs.4,000/- to Rs.5,000/- for each certificate; and ultimately, prayed to dismiss the application. 5.

There are specific and grave allegations in the first information report. The allegations do constitute the offences under Sections 120B, 406, 420, 467, 468, 471 472 I.P.C. There is nothing wrong in issue of first information report against the petitioner-A.3 and

other accused in the subject crime. The allegations require examination. Merely because the petitioner-A.3 is running Mee-Seva centre, it cannot be a ground to quash the proceedings. The petition is devoid of merits and it is liable to be dismissed.
