HONOURABLE.,USTICE G. SRI DEVI CRIMI NAL PETITION NO .264a OF 2021 ORDER:

This Criminal petition, under Section 43g of the Code of Criminal Procedure, l9Z3 (Cr.p.C.), is filed by the petitioner/A-2, for grant of anticipatory bail in Crime No.34 of 2O2l of P.S. Karepally, Khammam District, registered for the offences punishable under Sections 302, 324,506 r/w.109 of the Indian Penal Code.

Heard 'the learned counsel lor the petitioner/A- 2, the learned Assistant Public Prosecutor representing the respondent-State and perused the record.

As seen from the remand report of accused No. 1, it is crystal clear that the present petitioner/A-2 at t}:,e instance of A-1 had gone to the house of LW8 and asked him as to why the deceased had met him, for which LWS told him about the conversation took place between him and the deceased. This information was furnished by the present petitioner/A-2 to A1 over phone and also asked LW8 to talk with A- 1 . Further, after talking with LWS, A-1 became very angry and thought that if he would kil1 the deceased, no one comes forward to stop him in selling his house. On thinking so, A- 1 directed the present petitioner/A-2 to observe the movements of the deceased with an intention to kill the deceased. On that, the present petitioner/A-2 sneaked around the house of LW1, found the presence of the deceased and accordingly informed

the same to A-1. LWs 9 & 10, who were doing their household works, have seen the present petitioner/A-2 in front of the house. However, they did not suspect him since he is also the same villager. After completion of lunch at about 2.20p.m., the deceased and LW1 while chit-chating with each other in front of the room of LWl, at that time, the present petitioner/A-2 signalled to A- 1 and informed the location of LW1 and thereafter, A-1 has committed the crime. Thus, looking into tl-re nature of allegations levelled against the petitioner and his involvement in commission of the crime by giving information to A- 1 to commit the crime, I am not inclined to release the petitioner on anticipatory bail and accordingly his prayer for anticipatory bail is rejected. However, the petitioner is directed to surrender before the Court concerned within a period of fifteen (15) days from today and on such surrender and on filing an application for regular bail, the Court concerned shall consider the same in accordance with law.
