THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION NO.6899 OF 2019 ORDER:

Heard the Counsel for the petitioner and the learned Government Pleader for Revenue for respondents 1 and 2 and Sri P.B. Vijay Kumar, learned counsel for respondents 3 to 8.

In this Writ Petition, the petitioner has assailed the order in Memo No.18935/Regn.II/A1/2015 dt:15.03.2019 by the 1st respondent allowing the appeal filed by the respondents 3 to 8 under Section 70 of the Chit Fund Act, 1982 and remitting the matter back to the Deputy Registrar of Chits/Arbitrator, Erragadda, Hyderabad South. The ground on which the Writ Petition is filed is that there are no reasons for remand the matter to the Deputy Registrar of Chits by the 1st respondent.

Counsel for respondents also admit that there are no reasons for remanding the matter back to the 2nd respondent by 1st respondent. Therefore, the Writ Petition is allowed. The impugned memo dt.15.03.2019 of the 1st respondent is set aside, and the 1st respondent is directed to decide the said appeal strictly in accordance with law, after hearing both sides by giving reasons and he shall communicate the order which he would pass, to both parties. While deciding the appeal, the 1st respondent shall give hearing to the petitioner and respondents 3 to 8 and shall dispose of the said appeal within six weeks from the date of receipt of a copy of this order. Interim orders granted earlier is vacated and I.A. No.2 of 2019 is disposed of accordingly. No costs.
