THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.229 OF 2017 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondents 1 to 4. With their consent, the present writ petition is disposed of at the admission stage.

Since this Court is not adjudicating the matter on merits, it may not be necessary to issue notice to respondents 5 and 6. 3.

The present writ petition came to be filed with the following prayer:

"....to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus questioning the action of the respondents 1 to 4 in not taking any action of the respondents 5 & 6 for digging illegal conversions of the lands without taking any permission from the concern department and without following any procedure as illegal and arbitrary and voilative of principles of natural justice and contrary to various guidelines issued by the government and consequently direct the respondent to conduct hearing and enquiry in respect of the objection dated 19.12.2016." 4.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondent authorities to deal with the objections/representation dated 19.12.2016 made by the petitioners

CPK,J WP_229_2017 questioning the action of respondents 5 and 6 for digging illegal conversions of the lands.

Learned Government Pleader for Revenue would submit that he has no objection for the same provided the said representation is still pending consideration and no endorsements are made thereon. 6.

Having regard to the submissions made, the Writ Petition is disposed of directing the 2nd respondent to deal with the representation dated 19.12.2016 made by the petitioners and other villagers, in accordance with law. It is needless to mention that the 2nd respondent shall issue notice to the unofficial respondents herein and also hear them before passing any order on the said representation.
