This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.203 of 2025 before the Town V Police Station, Nizamabad, registered for the offence punishable under Sections 78, 107 of BNS (corresponding sections 354-D, 305 of IPC) Section 11 r/w 12 of POCSO Act.

The brief facts of the case are that on 18.10.2025 the de facto complainant lodged report stating that her minor daughter who is aged 16 years committed suicide due to harassment of petitioner who used to follow her continuously for sexual favours. Basing on the said report, a case was registered against the petitioner for the offences as alleged.

Heard Sri Muzaferrullah Khan, learned counsel for petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for respondent - State. 4.
Learned counsel for petitioner submitted that there is no information in the complaint itself with regard to the particulars or date of alleged harassment by the petitioner, and the same was improvised by the de facto complainant subsequently. He asserted that the petitioner has been languishing in jail since 05.12.2025 and in spite of passing of 90 days period from the date of remand, no charge sheet is filed. While averring the petitioner is innocent of the offence as alleged, he prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that there are serious and heinous allegations against the petitioner. While lamenting that due to continuous harassment of petitioner, the victim who was minor
committed suicide, he prayed this Court to dismiss the criminal petition.

Upon consideration of the rival submissions and perusal of the material available on record, it is noted that petitioner is in jail from 05.12.2025 and record would show that LWs.1 to 11 are already examined. Though charge sheet is not filed in spite of passing of 90 days period, considering the progress in investigation and the period of incarceration of petitioner, this Court is of the view to grant the relief of bail to petitioner, subject to compliance of following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/-, (Rupees Twenty Five Thousand only, with two sureties for a like sum each to the satisfaction of the Special Judicial Magistrate of First Class for Trial of Cases under TS Prohibition and Excise Act cum IV Additional Junior Civil Judge, Nizamabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
