ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.319 of 2026 before the Miyapur Police

Station, Cyberabad, registered for the offences punishable under Sections 69 of BNS.

The brief facts of the case are that the de facto complainant and the petitioner were in a relationship for about three and a half years under a promise of marriage. During this period, they lived together, and on 1st December 2025, the petitioner suddenly informed her that he had married another woman, which came as a great shock to her. During their stay together, there were occasions when the petitioner tried to force himself on her despite her reluctance. When she resisted and objected, he reacted angrily and subjected her to emotional and verbal abuse. She endured such behavior believing that they would stay together forever and trusting that his promise of marriage was genuine. As the engagement date approached, the petitioner continued to assure her that he would stop the marriage. However, later he stated that due to family and social pressure the wedding would proceed, but promised that he would divorce his wife immediately after the marriage. Feeling cheated and exploited physically and mentally under the false promise of marriage,

and alleging that the petitioner also extended threats and abuse, the de-facto complainant lodged the present complaint. 3.

Heard Sri E.Venkata Siddhartha, learned counsel appearing on behalf of the petitioner as well as Sri M.Rama Chandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and that the only allegation against him is that, at his instance, the de facto complainant and the petitioner were living together during the course of their relationship. During this period, the de facto complainant came to know that the petitioner was going to marry another girl. It is submitted that there was no promise of marriage made by the petitioner to the de facto complainant, and she had never insisted upon marriage, nor had the petitioner ever refused to marry her. Therefore, the allegations made against the petitioner are denied. It is further submitted that the petitioner's marriage was scheduled today, i.e., on 05.03.2026. Hence, it is prayed that this Court may be pleased to grant pre-arrest bail to the petitioner by allowing the present Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, stating that the averments in the complaint clearly disclose the offence under Section 69 of BNS, committed by the petitioner under the false promise of marriage. Therefore, it is contended that the petitioner is not entitled to be granted bail. However, it is further submitted that the investigation is still in progress, and requested to dismiss the present Criminal Petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that they were in living relationship for about three and half years and she insisted for marriage when petitioner herein has informed that he is going to marry another girl till such time there is no such refusal to marry the de-facto complainant. Considering the duration of the relationship and also the allegations reported by the petitioner, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Miyapur Police Station, Cyberabad Commissionerate,

within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482 of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
