THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6911 of 2019 O R D E R:

In this writ petition, the grievance of the petitioners is that the respondent authorities have not issued either notice under Section 146 of the Greater Hyderabad Municipal Corporation Act or notification as required under the provisions of the Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 proposing to acquire their land for the purpose of road widening.

On instructions, learned Standing Counsel for GHMC appearing for the respondents submits that as a matter of fact, the petitioners had encroached on to the road and constructed a compound wall and that the respondent Corporation may be given liberty to take appropriate steps against the petitioners with respect to their alleged encroachment.

Admittedly, the petitioners have constructed the compound wall encroaching on to the road. Hence, the writ petition is disposed of directing the respondent authorities to issue notice to the petitioners calling for their explanation and thereafter, take necessary steps in accordance with law. Without such procedure being followed, the respondent authorities shall not proceed further at this stage. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of.
