2016 basing on the enquiry report given by Respondent No.3 as illegal, arbitrary and violation of Article 14 and 21 of the Constitution of lndia and to set aside the same and consequently direct the respondents herein to reinstate the petitioner in to the service with all consequential benefits including the continuity of service and grant such other relief as it deems fit in the circumstances of the case.

NO: 15506 OF 20161 Petition under Section 151 cpc praying that in the circumstances stated in the affidavit filed in support of the petition, the High court may be pleased to direct the Respondent No.2 to reinstate the petitioner in to service immediately by suspending the operation of the Removal proceedings No.pi1136(1)/ 2015-KCG, Dated 12.02.2016, pending disposal of the above writ petition and to pass such other order or orders as this Hon'ble court may deems fit just and proper in the circumstances of the case.

When the matter was called on 29.09.2023, there was no representation on behalf of the petitioner. To give one opportunity, the matter was posted to 16.10.2023 under the caption for "final hearing". On 16.10.2023, also there was no representation on behalf of the petitioner either in the physical mode or virtual mode. Hence, this Court directed to list the matter on 18.lO.2O23 under the caption "for dismissal". Even today, there is no representation on behalf of the petitioner, either in the physical mode or virtual mode, though the matter is listed under the caption for dismissal'. It appears that the petitioner is not having any interest to prosecute the case. 2.
Hence, the writ petition is dismissed for nonprosecution. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed.
