HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37214 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the action of the respondents in seeking to demolish petitioner's house admeasuring 60 ankanams situated in survey No.950 in Kanupur Bit-I Revenue in Venkatachalam Grampanchayat, Venkatachalam Mandal, SPSR Nellore District and dispossess the petitioner therefrom despite the house site possession certificate No.267/14 dated 03.03.2014, as illegal and arbitrary.

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue (AP) for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The only grievance of the learned counsel for the petitioner is that the respondents are trying to dispossess the petitioner by demolishing the house of the petitioner without following due process of law. He further submits that in view of the possession certificate issued in favour of the petitioner, the respondents cannot dispossess the petitioner from the subject premises. Learned AGP would submit that any action by the respondent authorities would only be in accordance with law. Having regard to the rival submission made, the Writ Petition is disposed of directing the respondents not to demolish

the subject premises i.e. house admeasuring 60 ankanams situated in survey No.950 in Kanupur Bit-I Revenue in Venkatachalam Grampanchayat, Venkatachalam Mandal, SPSR Nellore District or dispossess the petitioner therefrom without following due process of law.
