THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.20667 of 2004 ORDER: (per SK,J) It is stated on behalf of Sri B.Narasimha Sarma, learned senior standing counsel for the Income-tax Department and the counsel for the petitioners in this case, that the Central Board of Direct Taxes had issued instructions to extend the benefit claimed by the respondent herein and in that view of the matter, he may be permitted to withdraw the writ petition.
Recording the statement of the learned counsel, the writ petition is dismissed as withdrawn.
Interim order dated 13.12.2004 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
