When the matter is taken up for hearing the learned counsel for the petitioner submits that the Criminal Petition has become infructuous as the cause in the petition does not survive.

In view of the representation made by the learned counsel for the petitioner, the Criminal Petition is dismissed as infructuous. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand dismissed.
