HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13156 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 15.06.2002 issued by the 2nd respondent altering the date of birth of the petitioner from 11.08.1955 to 26.08.1948, as illegal and arbitrary.

When the matter is taken up for hearing, learned standing counsel for TSRTC appearing on behalf of the respondents submits that the petitioner has attained the age of superannuation, even as per his correct date of birth and, hence, the cause in the writ petition does not survive.

In view of the submission made by the learned standing counsel for the respondents, the writ petition is dismissed as infructuous. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
