When the matter was called on 08.08.2017, since there was no representation for the appellant, the Registry was directed to list the matter under the caption "for dismissal".

2. Today also, there is no representation for the appellant. In fact, the appellant - defendant preferred the present appeal aggrieved over decreeing the suit by the Court below for Rs.1,09,950/-. It appears, the appellant is not interested in prosecuting the appeal.

3. Hence, the present appeal is dismissed for non-prosecution. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
