This petition is filed by the petitioners, who are A1 and A2, seeking to quash the proceedings in C.C.No.135 of 2011 on the file of the court of Special Mobile Judicial Magistrate of First Class, Nellore. The offences alleged are under Sections 420 and 406 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the 2nd respondent. Notice was sent to the 1st respondent. However, the counsel for the petitioenrs does not press upon the petition with regard to his prayer for quashing of the further proceedings against the petitioners. He restricts his prayer for a direction to be given to the court below to dispense with the presence of the petitioners before the court below, for which the 1st respondent's presence is not necessary. 3.

Hence, considering the said submission of the counsel for the petitioners, the criminal petition is dismissed directing the Court below not to insist upon the presence of the petitioners unless it is very much necessary for the proceedings of the case. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
