SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2088 OF 2018 ORDER:

This petition is filed seeking for modification of the order of the IV Additional Sessions Judge, Tirupati, Chittoor District, in Crl.M.P.No.23 of 2018, wherein the condition to release the petitioner on bail was to execute a bond for Rs.25,000/- with two sureties for a like sum each to the satisfaction of the V Additional Judicial First Class Magistrate, Tirupati and also the condition that the sureties shall produce title deeds of the properties for verification of the V Additional Judicial First Class Magistrate, Tirupati. 2.

The counsel, now, seeks for modification of the condition of executing a personal bond with two sureties for a like sum each to the satisfaction of the V Additional Judicial First Class Magistrate, Tirupati, on the ground that the Magistrate is insisting for local sureties and he contends that such condition is not imposed. But, the sureties to the satisfaction of the Magistrate, would take within its fold, the nature of the sureties also. However, considering the submission of the public prosecutor that the insistence of the Magistrate might be because of the petitioner hailing from Tamilnadu, can be taken care of by making it clear that one of the sureties shall be a local surety. Rest of the order is kept intact.

Accordingly, the Criminal Petition is partly allowed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
