ORDER

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.

This writ petition is filed seeking to declare the action of the respondents in not continuing the petitioner as fair price shop dealer, as arbitrary and illegal.

Petitioner was appointed as dealer of fair price shop No.17, Yerpedu Mandal, Tirupathi Division, Chittoor District, on permanent basis, and his licence was renewed from time to time. Learned counsel appearing for the petitioner submits that though the authorization of the petitioner was subsisting till March, 2015, the respondent-authorities stopped the supply of essential commodities to the fair price shop of the petitioner from November, 2014.

Learned Government Pleader for Civil Supplies submits that the petitioner himself has submitted the resignation letter on 25.10.2014 and that is the reason why the essential commodities were not supplied to the petitioner.

On the other hand, learned counsel appearing for the petitioner submits that the petitioner has not submitted any letter of resignation.

However, this Court is not inclined to decide that issue at this stage.

In the circumstances, the Writ Petition is disposed of

directing the 3rd respondent to issue notice to the petitioner with regard to the alleged letter of resignation and after receipt of such reply from the petitioner, pass necessary orders within a period of two months from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
