Y. Sambasiva Rao v. State Of Ap
HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.5709 of 2018 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Mines and Geology for respondent Nos.1 and 2 and perused the prayer in the writ petition with the supporting affidavit and other material on record.
2.
The prayer in the writ petition reads as follows: "......to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring action of the 1st respondent in not deciding the Revision dated 11.02.2010 filed by the petitioner, fixing the date of hearing before the concerned Minister as is being done earlier, in spite of several representations, the latest being dated 09.06.2017, as arbitrary, illegal, unjust, failure to exercise power, violative of the Fundamental Rights guaranteed under Articles 14 and 19 of the Constitution of India and consequently direct the 1st respondent to forthwith dispose of the revision dated 11.02.2010 and pass such other order or orders as are deemed fit and proper in the circumstances of the case."
3.
The only grievance of the petitioner from the prayer in the writ petition is that the revision, dated 11.02.2010, pending with the 1st respondent is not deciding despite several representations including by 09.06.2017. There is no say of the same is disposed of from the learned Government Pleader.
4.
Having regard to the above, the writ petition is disposed of directing the 1st respondent to dispose of the said revision on own merits after opportunity of hearing to the petitioner at any cost, within six weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending, if any, shall stand closed. No costs.
