THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.39448 of 2013 ORDER :

In this Writ Petition, the petitioner questions the order dt.19.11.2012 of the 2nd respondent confiscating petitioner's vehicle on the ground that there is violation of principles of natural justice.

A perusal of the impugned order states that several opportunities were given to petitioner and his counsel to appear before 2nd respondent, but the petitioner did not avail of the same. So the plea of petitioner that there was violation of principles of natural justice cannot be countenanced.

Although certain contentions on merits were sought to be raised by petitioner's counsel, I am not willing to entertain the same since petitioner has an effective remedy of an appeal against the impugned order before the Conservator of Forests, Wildlife Management Circle, Tirupathi.

Therefore, granting liberty to petitioner to approach the said Official by way of appeal, this Writ Petition is dismissed. No order as to costs. It is made clear that this Court has not expressed any opinion on the merits of the claim of petitioner.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
