THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.5727 OF 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home (TG) appearing for the official respondents.

When the matter is taken up, written instructions, dated 5.3.2018, furnished by the Sub-Inspector of Police, Godavarikhani I Town Police Station, Peddapalli District are placed on record by the learned Government Pleader for Home. The said instructions read as under:- "On receipt of a complaint from the petitioner herein lodged with the Police of Godavarikhani-I Town Police Station, Peddapalli District, a case in Cr.No.339/2017 U/secs.3(1)(r)(s) Act, dated 25.7.2017 was registered against 1) Md.Rasheed,

2) Sajahan, 3) A.Ramadevi and 4) A.Mahender (who are the unofficial respondents 4 to 7 herein) and as per the instructions of the Superintendent of Police, Peddapalli District, the Asst. Commissioner of Police, Godavarikhani Division has taken up the investigation into the case. During the course of investigation, the investigation officer (ACP, Godavarikhani Division) examined the complainant/petitioner herein and other witnesses and recorded their detailed statements. In the investigation it is clearly disclosed that the accused A1 and A2 have committed the offence mentioned in the FIR. There is no evidence established against the accused A3 and A4 who are the unofficial respondents 6 and 7 herein that they have committed any offence including the SC/ST (POA) Act.

Basing on the evidence, the investigation officer arrested the accused A1 and A2 and remanded them to judicial custody on 22.2.2018.

Proposals were submitted to the Superintendent of Police, Peddapalli District to delete the names of the remaining accused A3 and A4. Permission is awaited. It is pertinent to submit that the investigation is under progress. Appropriate report will be filed before the concerned Hon'ble Court at the earliest. To complete the investigation into the case, it requires some more time to the investigating agency."

On noticing the same, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Recording the said submission, the Writ Petition is disposed of, by placing on record the written instructions, dated 5.3.2018, furnished by the Sub-Inspector of Police, Godavarikhani I Town Police Station, Peddapalli District with a further direction to the respondent police authorities to complete the investigation as expeditiously as possible. There shall be no order as to costs. 5.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
