CVNR, J & TA, J WP 5739/2018 ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus directing the respondents to produce K. Vaishnavi, purported wife of the petitioner ("the alleged detenue"), before the Court and set her at liberty.
As undertaken by the learned Government Pleader for Home (AP) the Police have produced the alleged detenue before the Court. Respondent No.5, father of the alleged detenue, and his wife are also present in the Court. During the hearing, the alleged detenue while admitting that she married the petitioner without the knowledge and consent of their parents, however, stated that as she is interested in her career she is not prepared to join the petitioner and that she is under the care and custody of her parents with her free will and consent. Though the petitioner has spoken to the alleged detenue with the permission of the Court, the latter has refused to join his company.
In the light of the above, we are convinced that the alleged detenue is not in illegal custody of respondent No.5. Therefore, the writ petition is dismissed with liberty to the petitioner to avail appropriate legal remedies seeking
