None appears for the petitioner.
The relief sought for in this writ petition is to declare the guidelines issued in G.O.Ms.No.4 dated 19.02.2011, in modification of G.O.Ms.No.52 dated 18.12.2008, for appointment of fair price shop dealers, under Clause 7 of G.O.Ms.No.52 dated 18.12.2008, including the proceedings of the 2nd respondent dated 01.01.2011, as arbitrary and illegal. A consequential direction is sought to set aside the notification issued by the 2nd respondent on 01.01.2011. The notification, impugned in the writ petition, is a notice inviting applications, from interested eligible and local unemployed persons, for appointment of authorised fair price shop dealers. In terms of the said notification, the last date for receipt of applications was 17.01.2011 and the interview was to be held on 27.01.2011.
While the writ petition was admitted on 16.06.2011, no interim order was passed therein. Consequently the selection process, pursuant to the said notification, must have been held and completed more than seven years ago.
Learned Government Pleader for Civil Supplies would submit that, subsequently, a fresh notification was issued in the year 2016. It is evident, therefore, that the cause in the writ petition does not survive necessitating any further adjudication by this Court. The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
