THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14129 of 2015 ORDER:

This Criminal Petition is filed by the petitioner- A2 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.1099 of 2015 on the file of Uppal Police Station, Cyberabad, registered for the offence punishable under Sections 448, 427, 506, 323 IPC and 3(1)(x) of the SCs & STs (POA) Act.

Heard and perused the material available on record. It is alleged that the de facto complainant went to meet the owner of wine shop and while he was talking with the owner-Arjun, Ashraf Hussain and A.B. Sridhar Goud-A2 trespassed into the shop and damaged the liquor bottles. When the de facto complainant resisted, they caught hold Arjun and abused the de facto complainant in the name of his caste.

Considering the facts and circumstances of the case and the nature of the offence, this Court is inclined to pass the following order: The petitioner-A2 is directed to surrender before the Court concerned and file an application for regular bail. On such application being filed, the Court concerned shall consider the same on the same day in accordance with law.
