WRIT PETITION NO. 5826 OF 2018 O R D E R :
The petitioners states that they are the owners of an extent of Acs:15-35 guntas situated in survey Nos. 296, 361, 362, 296, and 362 of Gandhinagar village, Suryapet Mandal and district. There is a big well in an extent of Ac:1-00 and it was existing for more than 65 years. While so, a notice under Rule 3 of the A.P. Assigned Lands [Prohibition of Transfers] Rules, 2007 was issued on 02/02/2017 alleging that the first petitioner is a transferee of the said assigned land in an extent of Ac:1-00 situated in survey No.349 from the original assignee; Konduri Venkanna of the same village. The petitioner was directed to submit explanation within fifteen days. Accordingly the first petitioner submitted the explanation on 01/2/2017 denying the purchase of the property. Now the present writ petition is filed alleging
interference with the said property without passing any final orders by the second respondent.
2. The learned Government Pleader on the basis of information submitted that no final order was passed till today.
3. In view of the same, this Writ Petition is disposed of directing the second respondent not to interfere with the possession of the said land in an extent of Ac:1-00 situated in survey No. 349, Gandhinagar village, Suryapet Mandal and district, without passing final orders pursuant to the proceedings taken up under the provisions of A.P.Assigned Lands [Prohibition of Transfers] Act, 2007 on 02/02/2017. There shall be no order as to costs.
4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
