THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2684 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/A-1 seeking to quash the order, dated 4.1.2016, in Crl.M.P.No.7833 of 2015 in C.C.No.80 of 2011 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad and extend the custody of the passport till further orders.
2. Heard and perused the material available on record.
3. The offences alleged against the petitioner/A-1 along with other accused are punishable under Section 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
4. Earlier, the petitioner filed Criminal Revision Case No.1080 of 2015 for extension of time for appearance before the trial Court and vide order, 25.6.2015, this Court permitted him to stay in U.S.A. till 20.12.2015 and directed him to appear before the trial Court in the month of December, 2015 when a date is given by the trial Court after 20.12.2015. Grievance of the petitioner is that he is unable to return from U.S.A. and hence, prayed for further extension of time.

Considering the facts and circumstances of the case and in view of the fact that in Criminal Revision Case No.1080 of 2015, learned counsel for the petitioner agreed to proceed with the trial in the absence of the petitioner and also as the trial Court was directed to proceed with the trial if witnesses are present and permitted the petitioner to represent by his father Shyamsunder, the time for custody of the passport is extended till 28.9.2016.
6. Accordingly, the Criminal Petition is disposed of. Miscellaneous
