THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7326 OF 2017 ORDER:

Heard learned counsel for the petitioner/A1 and also the learned public prosecutor representing the respondents in the petition seeking to quash the proceedings of FIR.No.99 of 2017, dated 14.07.2017, on the file of Station House Officer, III Town Police Station, Nellore, SPSR Nellore District, registered for the offences punishable under sections 3, 4, 5 and 7 of PIT Act and perused the grounds urged in the quash petition and the panchanama and the FIR.

As the investigation is at nasal stage, there is nothing to quash the FIR, much less, to interdict the investigation. Hence, this criminal petition is disposed of, by left open all available defences. Needless to say, if at all in the event of any necessity of arrest of the petitioner, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
