THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.262 of 2016 ORDER:

This application is filed to withdraw O.S.No.382/2010 from District Judge for trial of cases under SCs & STs (Prevention of Atrocities) Act, to the file of VI Additional District Judge, Visakhapatnam to be tried along with O.S.No.169/2009.

2. These two suits are filed for relief of partition; one filed by the petitioners herein and the other filed by the respondents 2 & 3 in respect of the same properties.

3. Heard both sides.

4. Both sides admitted that O.S.No.169/2010 is at the stage of defendants' evidence and O.S.No.382/2010 is yet to commence and both sides submitted that let these two matters be transferred to one Court and direct the trial Court to try them together and dispose of simultaneously within a specified time.

Considering the contentions and rival contentions of both parties and submissions of both side Advocates, O.S.No.382/2010 is withdrawn from District Judge for trial of cases under SCs & STs (Prevention of Atrocities) Act and transferred to VI Additional District Judge, Visakhapatnam to be tried along with O.S.No.169/2010. The trial Court shall dispose of these two suits, as expeditiously as possible, preferably within four months from the date of receipt of the records.

6. Tr.CMP., is ordered accordingly.

As a sequel, miscellaneous petitions, if any, pending in this Tr.CMP., shall stand disposed of.
