THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5019 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 and 2 under Section 482 Cr.P.C. seeking to quash the order dated 19.2.2016 passed in Crl.M.P.No.1342 of 2015 in C.C.No.63 of 2016 by the XIII Metropolitan Magistrate, Cyberabad, L.B. Nagar, taking cognizance of the case for the offences punishable under Sections 384, 506 and 509 IPC against the petitioners.

Heard and perused the material available on record. It is alleged that the husband of the 2nd respondent is working in NGRI as a job contract and the authorities did not regularize his services and did not pay his salary for 10 months. A2 instigated the 2nd respondent by saying that the files in respect of her husband's job are with Vinod Dubey-A1, who is administrative officer, and he can regularise her husband's job, if she pays Rs.50,000/-. She paid the said amount. But A1 did not satisfy with that amount and he demanded her for sexual co-operation and he misbehaved with her and when she resisted, he threatened that if she reveals the matter to anyone, he will expel her husband from his services. Being afraid of the acts of A1, she left matrimonial home with an intention to commit suicide.

Coming to know about the same, her husband lodged a complaint and took her back. Then, the accused asked the 2nd respondent and her husband to withdraw the complaint and they agreed to release the arrears of 10 months salary of her husband. The 2nd respondent and her husband withdrew the complaint. But the accused failed to pay the salary of the husband of the 2nd respondent. The petitioners could not make any ground to interfere with the order of the trial Court. Therefore, this Court is not inclined to grant the relief sought by the petitioners.

evidence adduced by the 2nd respondent. On production of such evidence and on such application being filed, the trial Court is directed to consider the same in accordance with law. Till disposal of such application, the presence of the petitioners before the trial Court is dispensed with and the petitioners are directed to be represented through a Counsel before the trial Court.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
