THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4835 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.3 seeking grant of anticipatory bail in connection with crime No.1 of 2015 on the file of Srikalahasthi Rural Police Station, Chittoor District, registered for the offence under Sections 447, 324, 509, 506 r/w 34 IPC and under Section 3(i) (x) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
Learned counsel for the petitioner submits that there is no specific allegation against the petitioner herein and that the entire investigation in this case is completed and the charge sheet is also filed and the question of tampering the evidence does not arise. Therefore, he prayed that the petitioner may be granted anticipatory bail. Except the offence under Section 3(i)(x) of SC and ST (POA) Act, the other offences are not serious in nature. As far as the offence under Section 3(i)(x) of the SC and ST (POA) Act is concerned, no specific allegations are leveled against the petitioner herein. In the circumstances and since the petitioner is a lady, this Court is inclined to grant anticipatory bail to the petitioner. Hence, the petitioner/A.
3 is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, she shall be enlarged on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner/A.3 is directed to report before the Station House Officer as and when required.
The Criminal Petition is accordingly disposed of. _________________________
