THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15693 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner is a fair price shop dealer of shop No.14016 of Mugguvenkatapuram Village, Kalluru Mandal in Khammam District. The authorisation of the petitioner is valid up to 31.03.2016. While so, an inspection of the shop was conducted by the vigilance officials on 18.05.2015 and they found some variations. Pursuant to the report submitted by them, proceedings under Section 6A of the Essential Commodities Act were initiated. Though 6A proceedings were initiated, no action was independently taken under the provisions of the Control Order. In the circumstances, the petitioner filed the present Writ Petition for release of essential commodities. Learned Government Pleader took time for getting instructions on 05.06.2015. But, until today when the matter is listed, he did not receive any instructions.

In the circumstances, this Writ Petition is disposed of directing respondent Nos.2 and 3 to supply the essential commodities to the petitioner for distribution to the cardholders, so long as her authorisation is valid and in force. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
