... Petitioner And The State of Telangana and another.
... Respondents
HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT PUBLIC INTEREST LITIGATION No. 204 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) None appears for the petitioner.
Heard learned Government Pleader for Municipal Administration for respondent No.1.
The petitioner, in the instant PIL seeks the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, more particularly one in the nature of a Writ of Mandamus declaring the action of respondents in not removing the garbage from the streets of municipal corporations, excluding Greater Hyderabad Municipal Corporation (GHMC) and municipalities in the State of Telangana which is affecting health and sanitation of citizens which is violative of Article 21 of the Constitution of India and consequently direct the respondents to take immediate steps to remove garbage from public roads and pass such other order or orders as this Hon'ble Court may deem fit and proper."
Learned Standing Counsel for respondent No.1 has placed on record, a letter, dated 17.08.2015, issued by the Principal Secretary to Government of Telangana, Municipal Administration and Urban
Development Department, addressed to learned Advocate General informing that the strike of all workers in the municipal corporation and municipalities in the State of Telangana has been called off and the workers have resumed to duties on 15.08.2015. That seems to be the reason why neither the petitioner nor his Advocate is coming forward to work out this PIL.
Hence, we are constrained to dismiss the PIL for non-prosecution.
Order accordingly.
Consequently, miscellaneous petitions, if any, also stand disposed of.
