HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 5760 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has assailed the order dated 16.02.2018 in O.A.No. 272 of 2018 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby in the application filed by the petitioner under Section 19 of the Administrative Tribunal Act 1985, notices have been ordered to be issued to the respondents returnable in six weeks.

A similar issue came up before this Court in W.P.No. 4795 of 2018 and same was disposed of by suspending the operation of the Government Memo No.881534/ D1/ 2017-2, dated 30.01.2018 till final decision is taken by the learned Tribunal in O.A.No. 201 of 2018. In the present case also, the impugned proceedings are dated 30.01.2018. Therefore, the order dated 15.02.2018 passed in W.P.No. 4795 of 2018 is applicable to the instant case also.

Accordingly, we hereby suspend the proceedings dated 30.01.2018 and the consequential proceedings dated 31.01.2018 insofar as clarification No.5 is concerned, till final decision is taken by the learned Tribunal in O.A.No. 272 of 2018.

SKK,J & AKS,J WP_5760_2018 The writ petition is accordingly disposed of. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
